Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Ember Rose Tech LLC ("Ember Rose Tech," "we," "us," or "our") governing your use of the HangTime mobile application and any related services (collectively, the "Service").

By creating an account or using the Service in any way, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 13 years old to use HangTime. If you are between 13 and 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Description of the Service

HangTime is a calendar comparison application that helps users find mutually available time windows with friends or groups without revealing private calendar details. The Service reads free/busy data from connected calendars, applies user-defined blackout windows, and displays intersection results showing only times when all selected participants are available.

We offer two tiers of service:

• Free tier — available to all registered users at no charge, with features as described in the app and on our website.
• Premium tier — a paid subscription unlocking additional features, billed monthly ($4.99/month) or annually ($39.99/year) through the Apple App Store or Google Play Store.

3. Account Registration

To use HangTime, you must sign in with a Google, Apple, or Microsoft account. You are responsible for maintaining the security of your sign-in credentials and for all activity that occurs under your account. Notify us immediately at support@emberrosetech.com if you believe your account has been compromised.

You may not create accounts on behalf of others, share your account with others, or use the Service in any way that misrepresents your identity.

4. Calendar Access and Permissions

The Service requests permission to access your calendar's free/busy information through your calendar provider. By granting this permission, you authorize HangTime to retrieve free/busy time blocks for the purpose of running calendar comparisons.

You may revoke calendar access at any time through the app (Settings → Calendars) or through your calendar provider's connected-apps settings. Revoking access will prevent HangTime from retrieving your free/busy data, which will disable comparison features for your account.

You represent that you are authorized to grant the calendar access you provide to HangTime and that doing so does not violate any agreement with your calendar provider or employer.

5. Acceptable Use

You agree to use HangTime only for its intended purpose and in compliance with applicable laws. You agree not to:

• Use the Service to harass, stalk, or invade the privacy of any person.
• Attempt to reverse engineer, decompile, or access the source code of the Service.
• Use automated tools, bots, or scrapers to access or extract data from the Service.
• Attempt to gain unauthorized access to other users' accounts or data.
• Interfere with or disrupt the Service or its servers.
• Use the Service to transmit spam, malware, or any harmful content.
• Impersonate any person or entity when using the Service.
• Use the Service in any manner that could expose Ember Rose Tech to legal liability.

Violation of this section may result in immediate account termination.

6. Premium Subscriptions and Billing

Premium subscriptions are purchased and managed through the Apple App Store or Google Play Store. By subscribing, you agree to the billing terms of the applicable store platform.

• Billing. Subscriptions are billed in advance at the start of each billing period (monthly or annual). Prices are listed in USD.
• Auto-renewal. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period.
• Cancellation. You may cancel at any time through your App Store or Google Play subscription settings. Cancellation takes effect at the end of the current billing period — no partial refunds are issued for unused time, except where required by law.
• Price changes. We may change subscription pricing with reasonable advance notice. Continued use after a price change constitutes acceptance of the new price.

Refund requests are handled according to the applicable app store's refund policy. Contact support@emberrosetech.com if you believe you were billed in error.

7. Intellectual Property

All content, design, code, trademarks, logos, and other materials comprising the Service are owned by or licensed to Ember Rose Tech LLC and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent.

You retain ownership of any content you provide (such as blackout window labels or group names). By providing this content, you grant us a limited license to store and use it solely to operate the Service on your behalf.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please read it carefully.

9. Disclaimers

We do not guarantee the accuracy of calendar comparison results, which depend on the accuracy and availability of data from third-party calendar providers. We are not responsible for missed meetings, scheduling errors, or other consequences arising from reliance on HangTime results.

10. Limitation of Liability

Our total aggregate liability to you for any claims arising under these Terms shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim or (b) $10 USD.

11. Indemnification

You agree to defend, indemnify, and hold harmless Ember Rose Tech LLC and its officers, employees, and agents from any claims, losses, liabilities, damages, and expenses (including reasonable attorney's fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any third party's rights.

12. Termination

You may stop using the Service and delete your account at any time through Settings → Account → Delete Account.

We may suspend or terminate your account if you violate these Terms, if we are required to do so by law, or if we determine that continued access poses a risk to the Service or other users. We will provide reasonable notice where possible, except in cases of serious violations.

Upon termination, your right to use the Service ends immediately. Sections 7, 9, 10, 11, 13, and 14 of these Terms survive termination.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute arising under or related to these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in California, and you consent to personal jurisdiction in those courts.

Before filing any legal claim, you agree to first contact us at support@emberrosetech.com to attempt to resolve the dispute informally. We will make a good-faith effort to resolve concerns within 30 days.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you via push notification or email at least 14 days before the changes take effect. The "Effective date" at the top reflects when the current version took effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.
